Our general conditions of sale
The website is the property of Créatelier Caracolle in its entirety, and all rights pertaining thereto. Reproduction in whole or in part, is always subject to the authorization of the owners. However, hypertext links (hyperlinks) to the site are authorized without specific requests.
1. Acceptance of Terms
The customer acknowledges having read, when ordering, special conditions of sale stated on this screen and expressly accepts them without reservation.
These terms and conditions govern the contractual relationship between Créatelier Caracolle and the client, both parties accepting them without reservation. These general conditions of sale prevail over all other conditions contained in any other document, unless prior express and written consent.
Every item proposed on the site is described and presented with the highest possible accuracy. Registered photographs and texts illustrating the presented products are not contractual. Créatelier Caracolle takes great care in posting products information using the technical data from manufacturers. Consequently, if errors, colour differences or omissions were to occur in the presentation of the article, our responsibility could not be committed.
Any order is worth express and irrevocable acceptance of prices and descriptions of products available for sale. The customer declares to have read and accepted these terms and conditions before confirming any order.
The order is definitively validated by the customer once their payment method is chosen. However, it will definitely be taken into account by Créatelier Caracolle once the payment is received effectively.
Products proposed are subject to availability, provided that Créatelier Caracolle does all its best to have the majority of products available. But ruptures can occur between the time when the user places the order and the time when we prepare the order, so possible discrepancy is possible between the quantities available on the website and the quantities actually available.
In case of unavailability (out of stock) of a product: the user will receive a gift certificate or will be credited the amount of the product; should the unavailability be too large, the user would be notified via email or telephone.
Prices are mentioned in euros all taxes included.
Any change in the applicable rate would be reflected in product prices. After that instant, they are subject to change at any time.
In case of order towards a country other than Belgium, the customer becomes importer of the products concerned. For all products shipped outside of the European Union, the price is calculated excluding taxes automatically on the invoice. Customs duties or other taxes or import duties or state taxes may be due. These rights are not within the purview of Créatelier Caracolle.
The products remain the property of Créatelier Caracolle until full payment.
Créatelier Caracolle agrees to honour delivery of items ordered as soon as possible. The average time observed for the available items is 4/5 days on average for a home delivery. We shall not be held liable for late delivery, for any reason whatsoever.
You have the opportunity to indulge your billing address or another address (e.g. your workplace). Remember to specify it when you submit your order.
Créatelier Caracolle strives to meet deadlines for preparation and delivery. However, please remember that delivery times depend on the provider you have chosen.
7. Shipping costs
For orders less than €50, shipping costs are €4.5 via Kiala.
For an order over €50, shipping costs are offered.
For France (excluding overseas territories)
For orders less than €60, shipping costs are €6.95 via Mondial Relay.
For an order over €60 shipping costs are offered.
Should you country not be eligible during the validation of your order, please contact us, we will calculate the shipping costs and add them to the list of items.
In addition, for deliveries outside the EU, the customer agrees to pay all taxes due to the importation of products, customs duty, value added tax and other taxes due under the laws of the country of receipt of the order. All orders are intended for the personal use of customers; partial or complete resale of products is strictly forbidden for clients or recipients of products.
The price charged to the customer is the price indicated on the order confirmation sent by Créatelier Caracolle.
In order to let you choose your payment method, Créatelier Caracolle established all payment methods. You can choose from the following payment systems:
Immediate payments: credit card, PayPal
Deferred payments: transfer, at the store (onsite)
The account is charged the full amount of the order made by the customer. In case of rupture Créatelier Caracolle is committed to giving a purchase coupon or credit the customer within 15 days of the order.
9. Security payment
For payment with a credit/debit card, Créatelier Caracolle via Athos ensures secure payment system "CM-CIC Payment" and guarantees the confidentiality of payment. Créatelier Caracolle doesn't in any way have bank details entered during the online payment, which is processed by a third party banking organization. The connection between the client computer and the bank partner site when purchasing is fully secure and encrypted during data transfer. In case of payment refusal, the order is not made available to the client. Créatelier Caracolle reserves the right to not proceed with the order from a customer for whom issues already occurred. Créatelier Caracolle in any event retains ownership of undelivered items until full payment by the customer.
10. Return Policy
In the case of a defective product, the customer has a period of 30 working days* to contest the product.
In the case of a product not corresponding to the order, the customer has a period of 15 working days* to claim.
After these periods, the products delivered will be deemed compliant and accepted by the customer, and Créatelier Caracolle reserves the right to refuse the exchange, equity, or refund.
Créatelier Caracolle will refund or exchange defective products or not corresponding ones in a period less than or equal to 14 working days after receipt of the return by the customer.
Return costs are borne by the customer.

As provided by Article L121-16 of the Consumer Code and in the context of distance selling, the customer has a withdrawal period of 14 days from the delivery of his order to change his mind.
Return new article/item(s) in its (their) original packaging intact, with all accessories, user manuals and documentation to the following address:

In case of exercising the right of withdrawal, Créatelier Caracolle refunds without delay and at the latest within 15 days the full amount of items returned in good condition.
Return costs remain on the customer, only the price of the item(s) purchased will be refunded subject to the condition in which it was returned to the sender.
12. Protection of personal data
The information collected in the context of distance selling is mandatory, this information is necessary to processing and delivering orders and to preparing invoices.
The lack of information leads to the non-validation of the order. In accordance with the "Data Protection" law, the processing of personal information about customers has been declared to the National Commission for Computing and Liberties (CNIL). The customer has the right (Article 34 of the Law of January 6, 1978) to access, modify, rectify and delete data about himself, and it can processed by Créatelier Caracolle.
This information is strictly confidential and is intended only to Créatelier Caracolle.
This contract is subject to Belgian law. Créatelier Caracolle cannot be held liable for damages of any kind, whether bodily or material that could result from a malfunction or improper use of products sold. It is the same for any changes resulting from product manufacturers. The responsibility of Créatelier Caracolle will, in any event, be limited to the amount of the order and cannot be blamed for simple errors or omissions that may occur despite all precautions taken in presenting the products. In case of difficulties in the application of this contract, the buyer has the option, before any legal action to seek an amicable solution with the help of: a professional association for the industry, a consumer association or any other counsel of his choice. It is recalled that the search for amicable solution does not interrupt nor the "prompt deadline" of the legal guarantee, nor the duration of the contractual guarantee. It is also recalled that, in general and subject to the discretion of the courts, the respect of the provisions of this contract relating to the contractual guarantee assumes that the buyer honours its financial commitments to the seller.
Claims or disputes will always be received with attentive benevolence, good faith is always presumed in those who took the trouble to explain their situation. In case of dispute, the customer should first contact the company to obtain an amicable solution.
Otherwise, the 'Tribunal de Commerce de Liège' has exclusive jurisdiction, regardless of delivery location and method of payment accepted.
